A little background first,

if I did not listen to my lawyer, Petrel history may be different. When I was working on Geoframe, I had a crazy idea to visualize seismic and to creat grid for simulation. I wrote a mop-up and showed to big blue. To make a long story short, I did not get the deal.

I have a software/firmware company, PE Solve-ware in US. Other than the black oil simulator which I released to the public thru this forum, I also have economic evaluation package, seismic visualization and interpretation package, deepwater platform/facilty concept design selection package a corrosion monitor device firmware. I wanted to release them to the public. However, I don't want someone take the code and turn them into commercial product. I talked to my classmates. They suggest that I establish a company in China. Keep the software right in the company and charge the user a token fee for the software. I'm OK with the idea but I have absolutely zero knowledge of stating a company in China. How do you get the permit and what kind of loops that I have to jump thru. Educate me if you can.

It is very difficult to run a software business like this in China, since you need Guanxi to establish your commercial ralationship with these Chinese companies at first. Then they might use your apps. I suggest that if you can start a company in China and do the service overseas. It will be really fantastic!

My lawyer has been giving me advice and requirements for a WFOE. personally, I know the pitfall of creating a company in China. China is not known for transparency and every step can be a money pit. I really don't want to venture into it just for the purpose of releasing the source code. on the other hand I really hate 一堆王八蛋利用其它人源程序骗钱.

Anyway, I'm doing research to find a better way. I really appreciate any suggestions to reach my goal.

This is an interesting idea. Recently, I also focus on seismic attributes and simulation to build better reservoir model. As far as I know, some researchers introduced similar ideas in SEG 2009 Meeting and Short Course. One day, I hope to learn more your idea.

Thanks for the suggestion, However, one thing I want to clear, the purpose of the company is not for a revenue generating venture. The main purpose is to protect the software right and to prevent 王八蛋利用其它人源程序骗钱.


Personally, I'm fully aware the software market in China. I'm fully aware the hacking techniques (being one during the era of Lone Ranger). All softwares I developed for other companies have ping home feature. Based on the data I received, I have given up the idea making money from software in China long long time ago.

My PE Solve-ware which I incorported in 1983 holds the rights in US. I can sue any 王八蛋 if they try 利用my源程序骗钱 in the world except China and Russia. I don't mind to spend some fund to set up a company to get the rights to sue in China but my company boss (my wife) is not crazy spending potential a hugh figure of $$$ just for me to give away the code.

When I started my own company, I also did not have too much capital. The company has not made me super rich but with long hours and some luck, it feed my family and paid my kids' college.

The 1000 Plan(http://www.1000plan.org/) is a one of recruitment program of global experts. China government encouraged overseas experts to start their business in China in recent years. I guess that you can try, that will be very helpful for your company.

Otherwise, if you start business in China, you would find the upstream petroleum industry is a small circle. Any one "利用其它人源程序骗钱", he\she will be lose his credit in the industry. I think do not worry about your opensource . Cracking maybe is the biggest tumour. Protecting your software, I have no good idea. Our software just provide for ourselves and our sponsor.

Update: High level technology enterprise(innovation company) is also allowed many advantages in China.

Hello WZGME,

Based on the communications with my classmates, fellow forum members, info from 1000plan web site, I'm afraid that 1000plan is not a match for my plan because

1. I'm not looking for employment.
2. I have no desire in competiting for funding.
3. I'm not planning to live permanently in China. My kids are in US and I have no plan to uproot them nor stay away too far.
4. I'm way over their age limit.
5. I'm still tied by contract up to the date I retire.

Anyway, I passed this link to few ex-SIS colleagues. I believe they are interested.
